BETA AGREEMENT.

This Beta Test Agreement ("Beta Agreement") is between you and NomaticX, Inc. ("NomaticX") and applies when you join the Nomatic Atlas beta program or use a pre-release build, including builds through Apple TestFlight or Google Play testing tracks, and features labeled beta or preview (together, the "Beta").

The Beta is also governed by our Terms of Service, Privacy Policy, Community Guidelines, AI Terms, and App License. Where this Beta Agreement conflicts with them on a Beta-specific point, this Beta Agreement controls.

Beta access is by invitation, and we decide who joins and for how long. You must meet the eligibility requirements in the Terms of Service, including being 18 or older. Invitations, invite codes, and TestFlight links are personal to you. Don't share or sell them.

Participation is voluntary and unpaid. You can leave at any time by uninstalling the beta build, leaving the TestFlight or Play testing program, or telling us.

The Beta is pre-release software and is expected to contain bugs, errors, and incomplete features. Features may change, break, or be removed without notice, and may never be released. Beta builds may crash, drain battery, use more data, or lose data you create. Keep your own copies of anything important.

Because the Beta is still being tested, don't rely on beta features, maps, conditions, or AI for navigation or safety in the backcountry. Carry independent navigation and emergency tools. The outdoor-risk terms in the Terms of Service apply fully.

Unreleased features, designs, builds, and any non-public information we share about the Beta are our confidential information ("Beta Information"). Until we make it public, you agree to:

• not publicly post screenshots, recordings, or descriptions of unreleased features without our written OK;
• not share beta builds or access with anyone else; and
• use Beta Information only to test and give us feedback.

This doesn't cover information that is or becomes public through no fault of yours, that you already knew, or that you're legally required to disclose (tell us first if you can). You're always free to talk about your own content and your own experiences with other people you met on Nomatic Atlas.

We'd love your bug reports, ideas, and opinions ("Feedback"). You grant NomaticX a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate Feedback into our products and services without obligation or compensation to you. You're not required to give Feedback, and we're not required to use it.

Bug reports sent from the app may include your device model, OS and app version, and the report text you write. Don't include other people's personal information in Feedback.

Your account and content in the Beta are handled under the Privacy Policy. We may need to reset, migrate, or delete beta data as the product changes, and we'll try to give notice before we do. At the end of the Beta, your account will generally carry over to the public release unless you delete it.

Paid features may be free, discounted, or limited during the Beta. Beta pricing doesn't guarantee future pricing.

We can suspend or end the Beta, or your participation, at any time and for any reason. When we end your participation, stop using beta builds and delete them. Your confidentiality obligations continue until the Beta Information becomes public.

THE BETA IS PROVIDED "AS IS," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. The limitation of liability, indemnity, and dispute-resolution provisions of the Terms of Service, including binding arbitration and the class-action waiver, apply to the Beta.
